WITHDRAWAL
Right of withdrawal (Legislative Decree 22/05/99 nr.185)
Pursuant to Legislative Decree 15 January 1992 n. 50 and Legislative Decree 185 of 22 May 1999, the Consumer has the right to withdraw from the purchase without any penalty and without specifying the reason. To this end, you must send communication by registered letter with acknowledgment of receipt to: MARIA RISTALDO – Via Nazionale, 100 – 81050 San Tammaro (CE), to be sent peremptorily within ten days of receipt of the goods (the postmark is proof).

Upon delivery of the goods by the courier, the Customer is required to check:
1) that the number of packages delivered corresponds to what is indicated on the transport document;
2) that the packaging is intact, not damaged, wet or otherwise altered, including the closing materials.
Any damage or mismatch in the number of packages or indications must be immediately reported to the courier carrying out the delivery, adding the words "withdrawal with reservation due to lack and/or damage to a number... packages" on the appropriate accompanying document and confirmed , within seven calendar days via email minicaseificiopennacchio@gmail.com
Even if the packaging is intact, the goods must be checked within seven calendar days of receipt. Any hidden damage must be reported within seven calendar days to minicaseificiopennacchio@gmail.com.
Any report beyond the aforementioned terms and/or through different means than those indicated above will not be taken into consideration. For each declaration, the customer assumes full responsibility for what has been declared.
Once the courier document has been signed, the Customer will not be able to make any objection regarding the external characteristics of what was delivered and the number of packages received.

The withdrawal notice must contain: the indication of the items for which you intend to exercise the right of withdrawal, the Order Number with the purchase confirmation, the identification data (name, surname/company name, address, telephone number, e-mail) email), the bank details (Bank, current account holder, IBAN code) for the refund of the purchase amount.
Following receipt of the registered letter, MARIA RISTALDO will contact the Consumer and provide him with all the instructions necessary for the return of the goods, which must be carried out at the Consumer's expense and responsibility, by courier of his choice, no later than ten working days from authorization to withdraw.
All products for which the Consumer has exercised the right of withdrawal must be intact as well as the original packaging, complete in all its parts including the packaging material, any seals affixed, as well as any additional documentation; if the product for which the right of withdrawal has been exercised reaches MARIA RISTALDO damaged, the latter will be required exclusively to communicate this to the Consumer in order to allow him, where possible, to exercise his right of compensation against the courier chosen for the return of products. MARIA RISTALDO will not be liable under any circumstances for damage, theft or loss of returned products, until they have been returned. Any risk will therefore be borne exclusively by the Consumer. Once the integrity of the returned product has been verified, MARIA RISTALDO will refund the Consumer the entire amount paid for the products referred to in the Sales Contract subject to withdrawal, no later than 30 days from receipt of the same. The refund will be made by bank transfer to the coordinates indicated by the Consumer and will correspond to the value of the goods resulting from the invoice. The aforementioned amount will not include shipping costs in accordance with the art. 5, paragraph 6, Legislative Decree no. 185 of 05/22/1999.
If the Consumer violates, in whole or in part, the provisions dictated regarding withdrawal from these General Conditions, the Sales Contract will remain valid and effective and MARIA RISTALDO will return the unduly returned products to the Consumer, charging the latter the related shipping costs.
